New Analysis Measuring Access to Dental Care in Every State

Wednesday, May 31, 2017, 6 a.m. to 7 a.m. (Hawaii)

There is lots of debate about whether the U.S. has enough dentists. After two years of work, HPI is releasing new analysis for every state based on a novel, peer-reviewed methodology to measure access to dentists. The analysis specifically addresses the Medicaid population separately from the population in general. Come see the results for your state and what they imply for policymakers. Expert panelists will includeJayanthKumar, DDS, MPH, of the California Department of Public Health andMarty Milkovic, MSW, of the Connecticut Dental Health Partnership.

Here are the guidelines for submitting a classified ad.HDA Classified Adsarefree, come out on the 15th of each month, and can list anything at all.Just follow these 10 guidelines.
  1. Only HDA members can advertise. (No staff, corporate offices, vendors, representatives, agents, etc.)
  2. Admust contain the member’s namein this format, “Dr. Mary Jones”, either within the text or in the contact information.
  3. Ad can list a contact person who is not a member as long as member’s name is shown.
  4. Ads have afifty word limitincluding the headline.
  5. Sorry, no photos, websites or other links, capitalization or highlighting can be in the ads.
  6. Only two ads per member, per issue.
  7. Ad will run two months and will be automatically deleted after two months.
  8. You can resubmit the ad for reinsertion by resending the ad to HDA.
  9. Ads will be mailed to HDA members without email, emailed to those who have provided their email address, and posted to our website.
  10. Deadline for submission is the 13thof each month.

TheADA Newsreports that ADA members are being asked to review and comment on proposed changes to the ADA Constitution and Bylaws. “The major focus of the rewrite is to remove procedural and operational items with the intent that the ADA will be able to act more swiftly,” said Dr. Michael H. Halasz, chair of the Council on Ethics, Bylaws and Judicial Affairs. “The change in the Bylaws is significant, and a comment period allows interested parties more time to consider the changes.”

Thestate House and Senate Conference Committee has once again rescheduledHB 696toThursday, April 27at 10am.Clickherefor the text to HB 696.The repeated rescheduling indicates that at least some legislators have concerns about this bill. We observe that your calls are being heard. This bill may go down to the wire toFriday'slegislative deadline. We will continue to keep you informed.

At today's April 26 hearing, these bills passed:
HB 374will do a sunrise analysis about requiring certification of dental assistants.HDA has supported this bill as an alternative to the BAD language in HB 696. Clickherefor the text to HB 374.

HB 561would requiredentists who administer general anesthesia, deep sedation, or moderate (conscious) sedation to post notice of contact information for verification of the dentist's licensure, and authorization and permit, to administer anesthesia and sedation.Clickherefor the text to HB 561.

HB 563will allowfor general supervision (instead of requiring direct supervision) for patients of record provided that no irreversible procedures or block anesthesia is performed. HDA requested the favorable changes to the bill which now have been included. Clickherefor the text to HB 563.

The state House and Senate Conference Committee met on Friday 4/21 to discussHB 696 which HDA opposes. The bill makes changes to the Board of Dental Examiners and inserts rules into the statute which would prohibit dental assistants from applying topical fluoride. The committee hasrescheduled its hearing on the bill toMonday 4/24 at 1 p.m.This is a normal part of the legislative conference committee process.

2017 RenewalAND Continuing Education (CE) Requirements forDentists

Please note this license renewal information, and new requirement to complete a Basic Life Support (BLS) course:

Licenses for dentists and dental hygienists expire onDecember 31, 2017unless renewed.In order to renew, dentists and dental hygienists must meet the continuing education (“CE”) requirements.

This notice is posted at this linkhere-please take a few minutes to review it.Below is excerpt language on thenewrequirement:

#4. As a part of the CE requirements, all dentists shall complete a course in Basic Life Support (“BLS”) for Healthcare Providers approved by the American Red Cross or American Heart Association at least once every two years.Please be advised that this is a new requirement.The completion of a general CPR course will no longer be sufficient.

Why didn't we include Sen. Roz Baker?

Senator Baker proposed the dental assistant language that HDA opposes and she is the chairperson of the committee that advanced the bill.We believe additional emails at this time are not likely to change her view.

HB 696 also changes the name of the Board of Dental Examiners to the Board of Dentistry and Dental Hygiene and adds three dental hygienists to the board. An earlier version of the bill would have also allowed a version of licensure reciprocity which HDA opposed -- that provision is now removed from the bill. HDA is also monitoringHB 374which would require a sunrise analysis of certifying dental assistants. We believe that supporting HB 374 is further justification for setting aside HB 696. Why do a study on training if you have already enacted a law that prohibits dental assistants from applying topical fluoride?

We are also monitoring bills related to posting notice for dentists who administer anesthesia; a change from direct to general supervision for dentists overseeing the work of dental hygienists; and a bill that would promote school-based health.

The deadline for all bills to be finalized in committee isnext week Friday, April 28 -- butplease act immediatelyas HB 696 could be decided much sooner.

  2. Admust contain the member’s namein this format, “Dr. Mary Jones”, either within the text or in the contact information.
  3. Ad can list a contact person who is not a member as long as member’s name is shown.
  4. Ads have afifty word limitincluding the headline.
  5. Sorry, no photos, websites or other links, capitalization or highlighting can be in the ads.
  6. Only two ads per member, per issue.
  7. Ad will run two months and will be automatically deleted after two months.
  8. You can resubmit the ad for reinsertion by resending the ad to HDA.

Your advocacy made a difference! As mentioned,House Bill696was heard this week.Legislators cited overwhelming testimony and phone calls from Hawaii Dental Association members as reasons they removed provisions from HB 696 which would have increased licensing reciprocity without adequate safety protections. They also inserted a provision in the bill which willrequire it to undergo additional meetings and can no longer be advanced "as is." You can read the bill at this linkhere.

Our HDA Advocacy "Hero" Award goes to Dr. Ed Cassella for testifying against the measure. The success ofthe HDA Legislative Committee, chaired by Dr. Norman Chun, with consultant Melissa Pavlicek, would not be possible without the quick action of the HDA members -all of you.

Conference Committee members will need to be designated by the House and Senate, and then HB 696 will be considered further. Please remain vigilant -we will be calling on you for additional emails, phone calls, and help in the remaining weeks of the legislature.Session is expected to end onMay 4.

On April 3, the ADA launched an online search tool aimed at helping prospective patients connect with local ADA members. The Association is encouraging ADA member dentists to fill out theirFind-a-Dentistonline profile, which takes about five minutes, on average, to complete. ADA member dentists with completed profiles, especially those with photos, are prioritized in the online tool's search results.

"This campaign is designed to help our members succeed by helping fill holes in their schedules," said Dr. Craig Herre, chair of the ADA Council on Communications. "It will only succeed if members participate by completing their profile so that consumers have a good tool to use."

Profiles with photos receive 11 times more clicks on average than those without, Dr. Herre said. Members are able to see how many times their profiles have been viewed through their My ADA member dashboard.

I am pleased to share our press release that was just sent out, announcing the arrival of Kim Nguyen, our newExecutive Director:

HONOLULU, HI– The Hawaii Dental Association (HDA)on Mondaynamed Kim Nguyen as the organization’s new Executive Director. Nguyen is an experienced leader with over two decades of experience in the nonprofit sector.

“We’re extremely pleased to have someone of Kim’s caliber join our team,” said Dr. Steve Wilhite, who served as HDA’s Interim Executive Director during the leadership search and was also a Past President of the Association. “I’m confident that Kim will play a significant role in furthering our organization’s vision of maintaining the highest quality of standards for the dental health industry here in Hawaii.”

In her new position, Nguyen will work with the Board of Trustees to develop and enhance HDA’s programs and strategic plan. She will also spearhead the organization’s administration, fiscal management, and visibility in the community by working closely with other professional, civic and private organizations. “I’m looking forward to collaborating with our membership, decision-makers, and community to improve the dental well-being for all people in Hawaii,” said Nguyen.

Nguyen was most recently at the American Lung Association of the Mountain Pacific as its Hawaii Executive Director. Prior to that, she held leadership positions at WithinReach, a nonprofit health organization in Seattle providing hepatitis B education for high-risk populations throughout Washington state. She also worked in the public policy sector for the Washington State Dental Association and Lifelong AIDS Alliance, and in adult employment with the YWCA of Seattle and King County.

Nguyen grew up in Hawaii and traces her educational roots back to Iolani School. She earned her bachelor’s degree in Sociology from Washington’s Whitman College and a master’s degree in Social Work from the University of Washington. She is also a 2016 Weinberg Fellows graduate. Nguyen and her husband reside in Honolulu’s Kakaʻako district.

Aloha HDA Members,

This is Kim Nguyen, your new Hawaii Dental Association Executive Director, with a report from the state Capitol.

After an hour-long hearing before the joint House Health and Intrastate Commerce Committees today, the legislators have decided todeferSenate Bill 343which would have allowed licensure by reciprocity. This means that the bill will not advance this session and its companion bill is also dead.HDA strongly opposed this bill on the basis of public safety and more than 100 pieces of OPPOSITION testimony were generated, which helped convince members of the Intrastate Commerce Committee to defer the bill.
Senate Bill 371, which would have reconfigured (and re-named) the Board of Dental Examiners was amended to keep the focus on dentistry and add an additional dental hygienist to the board. This bill will next move the the House Consumer Protection Committee. Its companion bill did not advance. Our advocates met with the chair of the Consumer Protection Committee and they (and other members of the legislative committee) will continue to work with stakeholders to advocate for HDA members on this bill.

Your immediate action is needed to help stop “Licensing by Reciprocity” and “Reconfiguring the Board of Dental Examiner” bills. More than 100 members have authorized HDA to submit testimony opposing those bills (and you can too, see instructions at the end of this message).

Here is something the ADA is bringing to our attention andsome of youhave to be ready to comply with these new laws.


On Behalf of Craig Busey, ADA General Counsel, Division of Legal Affairs, we have important information to share.

The Americans with Disabilities Act (AwDA) requires that places of public accommodation, including physicians’ and dentists’ offices, be accessible to persons with disabilities. With the advent of the internet, and of websites that businesses utilize to provide additional access to the public, the U.S. Department of Justice has taken the position that websites open to the public must also be accessible in various ways to persons with sight or hearing impairment. This interpretation may affect not only the websites of our members, but also those of our associations themselves.

You may be aware that several member dentists in Texas have received letters from attorneys alleging that their websites violate the AwDA because the websites are not accessible to individuals with disabilities. The letters typically request the payment of some amount of money in order to avoid a lawsuit, and may also insist on prompt compliance with the law. As it is possible that other member dentists may receive similar letters, we thought some guidance might be helpful.

To assist both the members and the state associations with this issue, the ADA has prepared the following attached documents:
  1. Website Accessibility”. A quick rundown, in a brief, executive summary-type format, of steps that members should consider in the short term to make their websites less susceptible to a claim.
  1. “Website Accessibility Claims: Strategies for Dentists”. A “white paper” type document that describes in greater detail strategies for members (and their attorneys) in case they receive a demand letter of the type described above. The paper also includes the actions that members might consider in order to make their websites more fully accessible to persons with disabilities in the long term.

Because of the sensitive and strategic nature of this information, please urge your members and local societies to maintain it in confidence.

In addition to the attached resources, the ADA will also host aTwo-Part 90 Minute Website Accessibility Webinar onMarch 20thfrom12:00-1:30 p.m.to provide an overview of the American with Disabilities Act (AwDA) and answer any questions.
The first part of the webinar will include a general overview of the current accessibility environment, legal best practices (imagery, video, page titles, tables, content, color contrast) and resources. The second part of the webinar will provide a detailed tutorial session for those dental societies who are a part of the ADA Branded Web Template community. If your dental society is not currently using an ADA Branded Web Template you will not need to remain on the webinar for the second half.

Here are some things I can pass on that my website designer passed on to me:
  • There are some WordPress plugins available, like the one we used, to assist in compliance. There are a few others — they may be limited by the theme and or the age of the websites.
  • There are some newer WordPress templates that are 'Accessible' that dentists could move their content onto.
  • Some dentists have pretty dated websites. I would NOT employ a programmer to work on an older or HTLM site. It would likely cost more than moving to a WordPress site that will be continuously updated — until they come up with some other new platform.
  • They might want to test if their websites are accessible athttp://www.boia.org/then they can determine next steps.

Here is something the ADA is bringing to our attention andsome of youhave to be ready to comply with these new laws.


On Behalf of Craig Busey, ADA General Counsel, Division of Legal Affairs, we have important information to share.

The Americans with Disabilities Act (AwDA) requires that places of public accommodation, including physicians’ and dentists’ offices, be accessible to persons with disabilities. With the advent of the internet, and of websites that businesses utilize to provide additional access to the public, the U.S. Department of Justice has taken the position that websites open to the public must also be accessible in various ways to persons with sight or hearing impairment. This interpretation may affect not only the websites of our members, but also those of our associations themselves.

You may be aware that several member dentists in Texas have received letters from attorneys alleging that their websites violate the AwDA because the websites are not accessible to individuals with disabilities. The letters typically request the payment of some amount of money in order to avoid a lawsuit, and may also insist on prompt compliance with the law. As it is possible that other member dentists may receive similar letters, we thought some guidance might be helpful.

To assist both the members and the state associations with this issue, the ADA has prepared the following attached documents:

  1. Website Accessibility”. A quick rundown, in a brief, executive summary-type format, of steps that members should consider in the short term to make their websites less susceptible to a claim.
  1. “Website Accessibility Claims: Strategies for Dentists”. A “white paper” type document that describes in greater detail strategies for members (and their attorneys) in case they receive a demand letter of the type described above. The paper also includes the actions that members might consider in order to make their websites more fully accessible to persons with disabilities in the long term.

Because of the sensitive and strategic nature of this information, please urge your members and local societies to maintain it in confidence.

In addition to the attached resources, the ADA will also host aTwo-Part 90 Minute Website Accessibility Webinar onMarch 20thfrom12:00-1:30 p.m.to provide an overview of the American with Disabilities Act (AwDA) and answer any questions.
The first part of the webinar will include a general overview of the current accessibility environment, legal best practices (imagery, video, page titles, tables, content, color contrast) and resources. The second part of the webinar will provide a detailed tutorial session for those dental societies who are a part of the ADA Branded Web Template community. If your dental society is not currently using an ADA Branded Web Template you will not need to remain on the webinar for the second half.

Here are some things I can pass on that my website designer passed on to me:
  • There are some WordPress plugins available, like the one we used, to assist in compliance. There are a few others — they may be limited by the theme and or the age of the websites.
  • There are some newer WordPress templates that are 'Accessible' that dentists could move their content onto.
  • Some dentists have pretty dated websites. I would NOT employ a programmer to work on an older or HTLM site. It would likely cost more than moving to a WordPress site that will be continuously updated — until they come up with some other new platform.
  • They might want to test if their websites are accessible athttp://www.boia.org/then they can determine next steps.

Here are the guidelines for submitting a classified ad.HDA Classified Adsarefree, come out on the 15th of each month, and can list anything at all.Just follow these 10 guidelines.
  1. Only HDA members can advertise. (No staff, corporate offices, vendors, representatives, agents, etc.)
  2. Admust contain the member’s namein this format, “Dr. Mary Jones”, either within the text or in the contact information.
  3. Ad can list a contact person who is not a member as long as member’s name is shown.
  4. Ads have afifty word limitincluding the headline.
  5. Sorry, no photos, websites or other links, capitalization or highlighting can be in the ads.
  6. Only two ads per member, per issue.
  7. Ad will run two months and will be automatically deleted after two months.
  8. You can resubmit the ad for reinsertion by resending the ad to HDA.
  9. Ads will be mailed to HDA members without email, emailed to those who have provided their email address, and posted to our website.
  10. Deadline for submission is the 13thof each month.

LATEX GLOVES NOTICE

The Honolulu Star-Advertiser reported this past weekend that the new latex law went into effect on January 1, banning the use of latex by restaurant workers and "health care providers." The article went on to quote HDA testimony on an early less flexible version of the bill. The new law actually allows the use of latex by dentists and health care workers when patients affirmatively assent to its use. The ban applies if the patient is unable to consent. Here the section of the law stating such:

 

SECTION 2.Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

"§321-Dental health facilities; health care facilities; use of latex gloves.All personnel working in dental health facilities or health care facilities, including all facilities listed in section 321-11(10), shall be prohibited from using latex gloves for patient care where the patient is unconscious or otherwise physically unable to communicate.Where the patient is conscious and physically able to communicate, latex gloves may be used if the patient affirmatively states that the patient is not allergic to latex.

Here are the guidelines for submitting a classified ad.  HDA Classified Ads are free, come out on the 15th of each month, and can list anything at all. Just follow these 10 guidelines.
  1. Only HDA members can advertise. (No staff, corporate offices, vendors, representatives, agents, etc.)
  2. Ad must contain the member’s name in this format, “Dr. Mary Jones”, either within the text or in the contact information.
  3. Ad can list a contact person who is not a member as long as member’s name is shown.
  4. Ads have a fifty word limit including the headline.
  5. Sorry, no photos, websites or other links, capitalization or highlighting can be in the ads.
  6. Only two ads per member, per issue.
  7. Ad will run two months and will be automatically deleted after two months.
  8. You can resubmit the ad for reinsertion by re-sending the ad to HDA.

Aloha HDA members:

The ADA recently asked the Department of Health and Human Services (DHHS) Office of Civil Rights (OCR) for an extension of the implementation deadlines for the recently released final rule issued under Sec. 1557 of the Affordable Care Act, which prohibits discrimination in health care on the basis of race, color, national origin, age, disability and sex, including discrimination based on pregnancy, gender identity and sex stereotyping [and requires that, if needed, translation and interpretation services must be provided to the patients ( by the treating dentist) at no cost to the patient or the government.]

The rule, which was implemented July 18, applies to health care providers who receive certain funds through HHS, including Medicaid and the Children's Health Insurance Program [QUEST in Hawaii].

In a letter to the OCR director, ADA President Carol Gomez Summerhays and ADA Executive Director Kathleen O'Loughlin urged the agency to delay the enforcement date so that dentists will have sufficient time to understand the requirements.

"The ADA strongly supports nondiscrimination in health care and equal access to health care for all patients without regard to race, color, national origin, sex age, religion or disability, It has proven exceedingly difficult to advise our members on compliance with the rule in the extremely short timeline afforded by the OCR, especially because OCR staff have not addressed several questions we have posed regarding the rule."

The ADA Washington Office is ramping up lobbying on this issue, both with DHHS and on Capitol Hill. Strategies will include developing and spearheading a coalition of like-minded health care organizations

Aloha HDA members:

I hate long emails too.  But, I have heard from a few members about the Section 1557 requirements.  Click here.  And they wanted some more help with this so I figured maybe others could use that help as well. Sorry for the length but please go all the way to the end.

Here are some more things to consider:

  1. If you do not take Medicaid or Quest, or receive money in any other way from HHS, you are not required to follow these rules.
  2. If you do then as of July 18 you must follow these rules including the sections regarding discrimination and language access (translation and interpretation).  These are services you must provide to Limited English Proficiency (LEP) patients at no cost to them.
  3. You must post the nondiscrimination notice and taglines in your office, on your website and in other practice publications byOctober 16, 2016
  4. You probably should develop a Language Access Plan for your office. (not required)

 


Here is a sample of the non discrimination notice that you can download and use in your office:  Click here.

These are the top 15 languages spoken in Hawaii in descending order:  Ilocano, Tagalog, Japanese, Chinese, Korean, Spanish, Vietnamese, Samoan, Marshallese, Trukese, Hawaiian, Micronesian, Bisayan, Tongan, Laotian.


You need to post "tag lines" in each of these languages along with your non discrimination notice. They state, " ATTENTION: If you speak [insert language], language assistance services, free of charge, are available to you. Call 1-xxx-xxx-xxxx (TTY: 1-xxx-xxx-xxxx)."

Here is that tagline translated into each of the 15 languages.  Just download it and fill in your office phone number where indicated in each one by 1-xxx-xxx-xxxx.  If you don't have TTY delete that section of the tag line. Click here.

NOTE: You can combine both the notice and the tag lines in one document and post it in the office, on your website and in other practice publications.

 

It is probably a good idea to develop a Language Access Plan to have in the office.  It is not required but will help you organize your office and be prepared for any audit or investigation of your practice if a complaint is filed against you.

Finally, just to remind you, it is important to take some time to review the links below.  Here are a few important issues covered in the material in the links below:
 
An “individual with Limited English Proficiency (LEP)” is an individual whose primary language for communication is not English, and who has a limited ability to read, write, speak, or understand English.

To assess an individual’s need for language assistance, and the appropriate kind of language assistance, you can take factors such as these into account:
  • What kind of services are involved? How important are they?
  • What kind of communication is at issue?
  • What’s the risk to the individual with LEP if you don’t provide language assistance services?
  • How long and complex is the communication?
  • What is the context of the communication?
  • How prevalent this language in your area? Are you likely to encounter it?
  • How frequently do you actually encounter this language?
  • Have you explored the individual’s expressed a preference for a type of language assistance service? (Not all types work as well as others in providing meaningful access.)
If a bilingual adult comes with the individual with LEP, you may notrely on that adult to interpret, except:
  • In an emergency involving an imminent threat to someone’s safety or welfare, such as a dental emergency, where there’s no qualified interpreter immediately available, or
  • Where (1) the individual with LEP specifically requests that the adult interpret, (2) the adult agrees to interpret, and (3) it’s appropriate to rely on the adult under the circumstances.
 

 

You may not rely on a minor child to interpret, except in an emergency involving an imminent threat to someone’s safety or welfare where there is no qualified interpreter immediately available.

 

AND

Are there any exceptions? What if I can’t afford to provide an auxiliary aid or service?

You are not required to take any action that you can demonstrate would result in a fundamental alteration in the nature of your dental practice or in undue financial and administrative burdens. However, if you rely on this exception you have the burden of proof that fundamental alteration or undue financial and administrative burdens would result.

You are required to consider all resources available for use in the funding and operation of the service, program, or activity and you must document the reasons for reaching this conclusion. The decision must be made by the head of your dental practice or by a person designated by the head.

If there is an alternative available that would not result in such a burden or alteration but that would ensure that, to the maximum extent possible, that the individual with a disability receives your services, you must provide the alternative.

Dental offices required to post nondiscrimination notices,
provide enhanced language assistance


July 01, 2016:Washington— The federal Office for Civil Rights has issued a final rule prohibiting health care entitiesthat receive federal financial assistancefrom discriminating based on age, race, color, nationality, disability or gender.

According to the Office for Civil Rights,Section 1557is the first federal civil rights law barring discrimination on the basis of sex in health care.

The rule, which goes into effectJuly 18(IN TWO WEEKS), implementsSection 1557of the ACA andappliesONLY toany health care provider [dentist] who receives funds through Health and Human Services, including Medicaid andCHIP. [Quest]

According to OCR, the final rule does not apply to providers who only receive reimbursement under Medicare Part B, but the agency has not clarified if the rule applies to dentists who only receive reimbursement under Medicare Part C, also known as Medicare Advantage.

The Association has reached out to OCR regarding Medicare Part C providers, and will update the ADA News and other Association news channels when information is available.

FURTHER INFO FROM THE ADA:


On May 18, 2016, DHHS published a final rule underSection 1557of theAffordable Care Actto protect individuals fromdiscrimination in health care on the basis of race, color, national origin, age, disability, and sex, including discrimination based on pregnancy, gender identity, and sex stereotyping. (Section 1557 is enforced by the Office for Civil Rights, the federal agency that enforces HIPAA.)


The effective date of the final rule isJuly 18, 2016in thirteen days!


In addition to government enforcement,Section 1557permits an individual or entity to bring a civil actionto challenge a violation in a U.S. District Court.

The final rule will require a covered dental practice to post two kinds of notices:

(1) a notice of nondiscrimination, and

(2) taglines in the top 15 non-English languagesspoken in Hawaii indicating thatlanguage assistance services, free of charge, are available.
  • Both noticesmust be posted in the dental office and on the dental practice’s website, and in significant publications and communications, including communications with individuals.
  • The compliance date for the notices is 90 days after the effective date, orOctober 16, 2016.
  • In smaller publications and communications, such as postcards and tri-fold brochures, a dental practice may use a shorter form of the nondiscrimination statement and taglines in the top two non-English languages spoken in the state.
  • Covered dental practices are permitted to use up existing stock of pre-printed publications.

Additional provisions in the rule include:
  • Covered dental practices will be required to take reasonable steps to provide meaningful access to individuals with limited English proficiency (“LEP”) who are eligible to be served or likely to be encountered, and to take appropriate steps to ensure thatcommunications with individuals with disabilities are as effective as communications with others.
  • Interpreters and translators, including staff, must meet certain criteria.
  • Covered dental practices that provide health programs or activities through electronic and information technology, such as online appointment systems or electronic billing, must make the technology accessible to individuals with disabilities unless doing so would result in either undue financial and administrative burdens, or a fundamental alteration in the nature of the health program or activity.

HDA Marketplace
 
 
HDA Marketplace ads are different from the HDA Classified ads. HDA Marketplace ads are not free, come out on the 1st of each month, and can list anything at all.
  1. Anyone can advertise. (Dentist, staff, corporations, vendors, representatives, agents, etc.)
  2. Ad can be anonymous.
  3. Ad can list any contact person or no contact person, just contact email or phone.
  4. Up to 30 words costs $50 plus tax. Additional one dollar per word after 30. (Count includes up to a five word headline.)
  5. Links to photos, websites or other links can be in the ads for $10 additional per link.
  6. Each advertiser can place an unlimited number of ads per issue.
  7. Ad must be prepaid before it will run and we accept payment by check or credit card only.
  8. Ad will run one month only unless it is resubmitted by re-sending the ad to HDA with pre-payment.
  9. Ads will be mailed to HDA members without email, emailed to those who have provided their email address, and posted to our website.
  10. Deadline for submission is the 28th of each month.

Any communications containing Protected Health Information (PHI) (even including only the patient's name) must be handled with care. When communicating by voice in person or on the phone, or by voice mail, fax or by written letter you are quite secure in expecting that these styles of communications are relatively safe and secure.

Email and other electronic systems are different.  They are subject to exploitation by hackers and others who could capture PHI and use it for nefarious reasons.  

SO, even though HIPAA law does not require email encryption, itdoes require that you take serious precautions when sending unencrypted email containing PHI.

Even though it is not required, to avoid any question of breach of security you may want to consider encryption for all of your PHI containing email just so you do not have to do all of the precautions and notations required by HIPAA rules to make sure your unencrypted emails are safe.

The ADA has reviewed many of the providers of email encryption service and endorses a company called PBHS, click here.

This is the PBHS website and all ADA members are already pre registered to sign up for the service. The cost seems to be reasonable and you may want to do this so you can encrypt your patient emailseven though it is not required by the HIPAA rule.

BTW, once you have this service you can use it for all of your sensitive emails (not just PHI emails) and never worry about someone hacking your own private sensitive information from your emails including, DOB, SS number, bank account and CC info and much more.  (It has become that kind of world i guess.)

 

Finally, it is allowable to send unencrypted email containing PHI without the supporting structure required, in one particular case.  

That is if the patient approves (in writing) the use of unencrypted email containing their PHI and therefore allows you to do just that.

The ADA has developed extensive privacy polices and forms to protect you in this area that you can copy and use in your office. 

So please click here to see documents including a form that a patient can sign to authorize you to send unencrypted email containing their PHI.

Then you can download them to your computer and customize them for your practice.

You can also get many helpful forms like these from your malpractice carrier.  Just call and ask and they will be glad to help.

Here is a note from ADA writer Kelly Soderlund about the ADA taking a stand for our interests with the national office of Delta Dental.  HDS, which is the local Delta Dental affiliate, is not following this national policy.

The ADA Council on Dental Benefit Programs wants Delta Dental to reject a proposed policy that would automatically disallow claims where more than two quadrants of scaling and root planing were performed on the same date of service. [Not in effect with HDS in Hawaii.]

Dr. Ron Riggins, council chair, sent a statement on behalf of the council to Dr. Bill Kohn, vice president of dental science and policy, on April 27 asking that the Delta Dental Plans Association policy committee reject the automatic disallow policy.

"We feel this new policy not only intercedes into dental care treatment planning but may also harm patients by creating unwarranted challenges to their scheduling for needed treatment," Dr. Riggins wrote. "Interference with the doctor-patient relationship is ever increasing and is of significant concern to the ADA."

Delta Dental will accept claims for scaling and root planing for more than two quadrants that are performed over multiple days but considers more than two quadrants on the same date of service to be a "quality of care" issue, according to the statement.

"Based on the most current published professional knowledge, it is clear that scaling and root planing for more than two quadrants on the same date of service, when performed properly, is an appropriate treatment choice," according to the council's statement. "The doctor and patient alone are in the best position to determine patient centered treatment plans and the time frames for delivery of the indicated care. A policy that automatically rejects this treatment, which is based on the doctor's best judgment, is unacceptable."

Dr. Kohn emailed a statement saying that Delta Dental Plans Association does not comment on confidential internal policy matters.

"The focus of our policies is simple: to ensure cost-effective access to quality oral health care for more than 68 million Americans," Dr. Kohn wrote. "Every year, Delta Dental, like other carriers, reviews millions of claims, watching for over-use, irregularities, and abuse. Combined with an ongoing assessment of our processing policies, this is part of our continual efforts to support evidence-based health care, best practices, avoidance of unnecessary costs for consumers, and, above all, optimal patient outcomes."

Dr. Riggins said Delta Dental's response is disappointing considering many of its state plans are already implementing this policy.

"We know for certain that member Delta companies already enforce this policy within their states [not in Hawaii] based on calls to those companies and information from respective state dental associations," Dr. Riggins said. "We don't understand how this policy is cost effective. For who? The patient who has to now pay for multiple dental appointments?"

Dr. Riggins also called into question Dr. Kohn not referencing the evidence the Council on Dental Benefit Programs provided in its statement, considering it referenced a policy statement and a research study to support its definition of quality of care.

"I don't think Delta Dental executives are in a position to deem any treatment necessary or unnecessary," Dr. Riggins said. "That's at the discretion of the dentist and the patient; a relationship we want to protect and one we want to thrive."

The letter is one of many examples of the Council on Dental Benefit Programs advocating on members' behalf, Dr. Riggins said.

"We consider ourselves the champions for our members and typically have a direct pipeline to the ears of many leaders within the third-party payer industry," Dr. Riggins said. "This is why members join the ADA: to have experienced staff and volunteer leaders advocate for them so they can concentrate on their patients and practices."

The ADA is standing up for members.  Here in Hawaii the local Delta Dental, HDS, is not implementing this policy

You may have received an email today from CMS (Centers for Medicare and Medicaid Services) reminding you to "review your data before it becomes available to the public". (Even if you have not, please read on.)  It stated:
"Review and dispute for the June 30, 2016 Open Payments data publication opened on Friday, April 1, 2016, and will last for 45 days.  CMS will publish the 2015 payment data and updates to the 2013 and 2014 data on June 30, 2016."

What are they talking about?

Well, as part of the Affordable Care Act there is a new requirement forcompanies who compensate doctors to speak for them or represent them, to report those payments to CMS and its called Open Payments (sometimes referred to as Physician Payments Sunshine Act.) 

The idea is that the public can go to a website and see which doctors (dentists included) are being paid, in what amount and by what companies.

So you can review your listing, if any, and you can dispute any of the data they may have about you and have it removed or changed if it is incorrect but you must do that by May 15, 2016.

You can go to the Open Payments website by clicking here. And get lots of answers to questions.

You can look at the Open Payments summary data sheet by clicking here.

And you can enter your name into the Open Payments search tool and see if you are even listed in the database.  Click here.

This morning, the Centers for Disease Control and Prevention (CDC) held a webinar on its new resources on infection control in dental settings.

The CDC released a new document to supplement its 2003 guidelines,  
Summary of Infection Prevention Practices for Dental Settings: Basic Expectation for Safe Care.

The document combines recommendations from the 2003 guidelines with additional CDC recommendations published since 2003.

The new document is not a replacement for the 2003 recommendations, but rather provides handy checklists and helpful tools to help dental health care professionals.
